Your insolvency team

Our outstanding lawyers and advisors regularly deal with all types of contentious and non-contentious insolvency issues for businesses and individuals, including buyer side in the sale of insolvent businesses or assets, together with trading advice to office-holders and other stakeholders affected by the insolvency.

Specialists from our team will ensure you have everything you need to navigate the complexities of restructuring, and if necessary, can also provide support for litigation claims arising from the insolvency process.

As our client, you’ll benefit from completely bespoke support and a multi-disciplinary approach that utilises the best of our expertise from around the firm, including our US Bankruptcy Team based in Delaware, New York and Washington, D.C.

We offer guidance to clients in all the sectors we operate in (including both Scottish and English law matters), and we’ve established a strong reputation for our work in the Energy, Retail & Hospitality, Financial Services, Education and Charity sectors.

Our contentious insolvency and asset recovery team offer expertise in investigations, disputes and asset recovery actions, with three core areas of expertise: complex investigations and litigation (fraud and other serious misconduct); Insolvency Act claims and applications; and cross-border claims and disputes.

Clients include insolvency practitioners, companies, directors and shareholders, individuals, financial institutions, insurers, government agencies, creditors and other stakeholders.

  • Detailed investigations into companies which have used aggressive tax avoidance schemes involving millions of pounds being paid to former directors/employees tax-free, and subsequent court proceedings to recover funds for the benefit of creditors
  • Advised a private credit client on the purchase of a large marina from its administrators, which also involved connected buy-side transactions with public body vendors
  • Investigating and challenging the disposal of the business and/or assets of companies facing significant actual and/or contingent claims by creditors on the basis that the 'restructuring' was an attempt to put assets beyond the reach of creditors
  • Acting for the administrators of a chain of pharmacies across the North of England, providing trading advice (including regulatory and property) leading to the ultimate sale of the businesses as a going concern
  • Acting for an overseas liquidator of multiple companies involved in a Ponzi scheme. Assisting the liquidator with recognition of the foreign insolvency in order to bring claims to recover assets based in the UK.
