Expanding international cooperation on export controls and enforcement

In early June 2023, legislation was proposed in the U.S. Congress to amend the U.S. Arms Export Control Act to provide an exemption for licensing of defence items for export to the United Kingdom (U.K.).

On 8 June 2023, the White House announced the “Atlantic Declaration” as a “Twenty-First Century U.S.-U.K. Economic Partnership to ensure that our unique alliance is adapted, reinforced, and reimagined for the challenges of this moment.”

And on 28 June 2023, the U.S. announced their agreement with the U.K., Australia, Canada, and New Zealand –to formally coordinate on the enforcement of each country’s export control regimes.

Changes applying to the thresholds for public procurements

On 1 November 2021, the government laid the Public Procurement (Agreement on Government Procurement) (Thresholds) (Amendment) Regulations 2021 (SI 2021/1221) (Regulations) before Parliament. The Regulations will come into force on 1 January 2022 and will only apply to procurements commenced after the Regulations come into force.

A sea change in investment regulation - the National Security and Investment Bill and the impact on M&A

The National Security and Investment Bill (NSI Bill) is currently working its way through Parliament. If passed, the changes introduced by the NSI Bill represent a significant expansion to investment regulation in the UK. Although the NSI Bill is not currently in force, it is already impacting M&A in certain sectors due to the proposed retroactive nature of some provisions.
