Partner in Womble Bond Dickinson's commercial team Stephen Anderson has discussed the changes to espionage offences in the National Security Act 2023 with leading IP sector outlet IAM.

The National Security Act 2023 received Royal Assent on 11 July 2023, and with the new legislation changing what businesses need to do when sharing a trade secret, Stephen highlighted key questions businesses need to consider when sharing a trade secret.

As reported in IAM, Stephen said companies should consider "whether they have properly vetted the person they are about to share information with, in case that person could represent a foreign power” among other questions such as who can authorise the sharing of secrets and whether employees need to be informed of the new Act.
