Luke specialises in litigation and disputes resolution. His expertise includes advising in breach of contract and tort claims across a number of industries.
He regularly brings and defends claims in the County Court, High Court and Court of Appeal, including claims for injunctive relief, and deploys Alternative Dispute Resolution procedures to achieve commercial outcomes for our clients.
Luke has particular expertise in the Energy & Natural Resources and Financial Institutions sectors, and is an associate member of Nara (the Association of Property and Fixed Charge Receivers).
Experience
- Bringing and defending numerous claims for energy suppliers in disputes covering all aspects of the industry, including disputes with customers and with other industry participants
- Advising insolvency practitioners on issues arising from supplier insolvencies and the operation of the Supplier of Last Resort regime
- Bringing judicial review proceedings against Ofgem and advising on referrals to Ofgem
- Advising generation companies in disputes relating to onshore and offshore wind, CHP and CCGT power stations, and connections to the transmission grid
- Advising banks in claims against their suppliers and other banks, including under complex intra-bank indemnities
- Defending banks against customer claims, including cases brought under the CCA, breach of mandate, mis-selling and fraud cases
- Acting for lenders in mortgage possession claims and for LPA receivers, in hundreds of cases concerning commercial, residential and agricultural properties
- Bringing claims for merchant acquirers, asset finance houses, financial adviser networks, insurers and other financial services providers
- Bringing and defending numerous complex and high value claims under Share Purchase Agreements for breach of warranties and indemnities
- Acting for retailers, manufacturers, transport companies, charities, public sector organisations and other clients in a range of disputes relating to the supply of goods and services
- Advising directors, companies and insolvency practitioners in cases concerning shareholder disputes and directors' duties and acting in claims by office holders
- Acting for creditors and debtors in contested insolvency proceedings.
