Justine Kelly’s practice focuses on eDiscovery representing corporate clients in the collection, review and production of electronic and paper files. Justine provides guidance and counsel to clients and case teams on legal matters that arise throughout the discovery process. She consults on eDiscovery issues in various types of matters including product liability litigations, civil litigations, anti-trust litigations, and government investigations including the US Department of Justice, the Federal Trade Commission and the Consumer Protection Safety Commission.

As part of the leadership team for the Firm’s BullDox group, Justine assists with the development and implementation of case document review strategies. She has experience leading teams of document reviewers and using cost-effective electronic discovery technology methods in litigation discovery efforts. She has extensive experience with privilege review issues and the creation of privilege logs for production in numerous litigations. She applies proven processes to collections and reviews to ensure defensibility, quality control, and consistent service delivery to clients. She advises case teams and clients on a variety of e-discovery-related issues, including: ESI agreements and protocols; effective legal hold and document preservation strategies; conducting defensible and targeted document collections; crafting search terms; streamlining discovery; and third party and government subpoena responses.

  • Managed collection of electronic and paper files and supervised a team of attorneys in reviews utilizing complex analytics and predictive coding to reduce data set involving a civil investigative demand by the DOJ for a large public hospital consortium.
  • Managed and supervised review team in the review for privilege of over 90,000 documents in an antitrust litigation involving a pharmaceutical company as well as preparation of multiple, rolling privilege logs for the matter.
  • Managed collection of electronic and paper files and supervised a team of attorneys in privilege review and logging involving a civil investigative demand by the CPSC for an international manufacturer of consumer electronics.
  • Justine participated as a panelist in a "Meet & Confer checklist: strategies for negotiating search terms with the opposing side” panel discussion for Women in eDiscovery Raleigh-Durham Chapter.
  • Justine was a panelist at the Data4Decisions Conference discussing Technology Assisted Review focusing on the use of predictive coding and data analytics in large scale litigation discovery efforts.
