Womble Bond Dickinson (WBD) has recruited competition partner Andrij Jurkiw from Mishcon de Reya where he was Head of Competition. Andrij specialises in UK & EU Competition Law and works across all sectors with particular experience of the FMCG, food, building materials, basic chemicals, recruitment, pharma, real estate, technology and transport sectors.
On the transactional side, Andrij advises on merger filing requirements, merger clearances, restrictive covenants and the enforceability of restrictions in commercial agreements. His experience includes Phase II merger filings, merger filings in the UK, under the EU Merger Regulation and in other overseas jurisdictions. He also advises on the application of the State Aid and/or EU Procurement Rules to Real Estate transactions and the application of the EU Competition Rules to technology agreements.
In addition, Andrij regularly advises businesses under investigation by the EU and/or the UK CMA or FCA, which includes attending Dawn Raids, advising on defence strategies, assisting with responses to information requests, applying for leniency (where appropriate) and making appropriate submissions, appealing decisions by Competition Regulators, and advising individuals accused of the Criminal Cartel Offence or facing a Competition Disqualification Order.
On the contentious side, he has extensive experience of successfully defending and bringing damages claims, challenges to the unfair exploitation of market power, litigation involving Standard Essential Patents, challenges under the EU Procurement Rules, complaints and/or challenges involving unlawful State Aid, and Judicial Review proceedings involving Competition Law.
Andrij also advises parties on CMA reviews of undertakings, and responding effectively to sector/market inquiries.
He has advised extensively on pricing practices in the FMCG and food sectors and dealt with numerous allegations of predatory pricing. He has also advised on strategies for dealing with parallel imports.
