The UK Supreme Court has issued a decision on a trade mark dispute between Sky and SkyKick confirming that a trade mark can be invalidated on the grounds that the applicant filed for goods and/or services it had no intention to use the trade mark for. The invalidation would only affect those goods and/or services for which intention to use was not found.
