Fiona works within the Residential Team and is part of the Real Estate Group. She specialises in acting for developers acquiring land for residential development. She provides pre-contract advice and is experienced in preparing and negotiating conditional contracts and option agreements. Fiona also advices on ancillary documentation, including licences, deeds of easement and releases, overage agreements and infrastructure documents. She also has experience acting for landowners in disposing of property for development.
Experience
Examples of experience include:
- Acting for a national retirement housebuilder acquiring up to 100 sites a year for development, including:
- The acquisition of a retail warehouse conditional on planning and satisfaction of title conditions. The contract also incorporated build schedules, a retail lease and the developer submitting an application for residential dwellings on the seller's retained land
- The third phase of a large development comprising a mixture of affordable and age-restricted housing with assisted-living. The deal included negotiating the release of a restrictive covenant and procuring indemnity insurance for the residual risk
- Drafting and negotiating seven option agreements and two unconditional contracts on the acquisition of nine garden plots for residential development. The transaction involved multiple solicitors and an overseas party. The client sought finance and all lender requirements and documents were completed within the period from exercise to completion
- Acting for a developer on assignment of an option agreement for a small residential development and dealing with the assignment of plans, general copyright matters and reliance letters
- Dealing with golden brick contracts, development agreements and disposals of affordable housing to RPs.
