Elizabeth specialises in all aspects of residential property litigation including acting for private landlords in relation to assured, assured shorthold, Rent Act tenancies and licencees and particularly in relation to all aspects of possession claims, including forfeiture claims and drafting Notices to Court advocacy. She also acts on disrepair and dilapidation claims, tenancy deposit disputes and succession claims.
Elizabeth acts for social housing clients in relation to possession claims and statutory injunctions to prevent anti-social behaviour and deals regularly with public law and Human Rights Act challenges. She also undertakes training nationally for clients and for sector leaders such as the Chartered Institute of Housing.
Elizabeth’s experience extends to agricultural disputes including landlord and tenant succession, farming partnership disputes, rights of way claims, mineral rights disputes, contractual disputes, co-ownership and trust disputes. She also advises on possession claims and insolvency. She is a Fellow of the Agricultural Law Association.
Experience
Examples of experience include:
- successfully represented a social housing landlord on obtaining an anti-social behaviour injunction with a power of arrest initially on an ex-parte basis and subsequently prosecuting a number of breaches of the Court Order and obtaining a number of committals for contempt of a Court Order
- acting for a tenant farmer in the reported Agricultural Land Tribunal case of Monkman v Mitchelson. The issue for the tribunal was whether Mr Monkman was eligible to be granted a new tenancy of a farm in succession to his father and particularly whether he satisfied the relevant statutory test
- acting for the claimant body in relation to the acquisition of an easement to park several cars in an area of land adjacent to an important historic building in York. The matter was settled at mediation, and
- representing numerous large land and estate owners including representing a large landed Estate in relation to trespass by developers into mines and minerals owned by them.
