Marjorie Spivak represents telecommunications and broadband providers nationwide, offering strategic legal and business counsel on all aspects of regulatory compliance. She advises clients on a broad range of regulatory, transactional, and contractual matters, supporting operations across both rural and urban markets. Her clients operate wireless and wireline networks, leveraging licensed and unlicensed spectrum to deliver innovative communications services.
Marjorie plays a key role in helping her clients acquire spectrum for the deployment of new technologies and services. She also brings extensive experience in tower siting and infrastructure development, guiding carriers, and infrastructure companies through the complexities of site acquisition, zoning, and compliance with federal and state regulatory frameworks—including the National Environmental Policy Act (NEPA) and the National Historic Preservation Act (NHPA).
Marjorie also advises utilities and large enterprise clients on regulatory, policy, and compliance matters related to FCC radio licenses and spectrum management. Her work includes securing necessary approvals for the licensing of transmission lines, as well as the sale and acquisition of generation facilities and other utility assets that utilize FCC-licensed radio equipment. She has deep experience with experimental authorizations for emerging technologies and services.
Marjorie has developed a niche practice assisting wind farm operators in licensing Aircraft Detection Lighting Systems (ADLS) with the FCC—an area that requires careful navigation of FCC rules and compliance with the National Environmental Policy Act (NEPA).
Marjorie also assists clients with privacy, data security and cybersecurity to ensure compliance with the federal and state rules, regulations, and policies. Marjorie also has extensive experience counseling clients on matters involving CALEA, FISA, subpoenas, and court orders.
With a background in broadcasting, Marjorie launched her legal career in the early 1990s, at a time when the FCC was conducting lotteries to award rural cellular market licenses. Since then, she has provided both business and legal counsel to a wide range of start-up communications ventures, with a particular focus on wireless services. Marjorie has played a pivotal role in helping these ventures evolve into dynamic, multi-faceted providers of wide-area communications services.

- Assisted multiple large enterprise wind operating companies obtain FCC licenses for Aircraft Detection Lighting Systems and comply with FCC environmental requirements to construct and operate such systems.
- Assisted multiple manufacturers obtain experimental authorizations to test new equipment and technology.
- Conducted numerous due diligence reviews of FCC licenses as part of large transactions to ensure compliance with FCC regulatory requirements.
- Represented major tower company guiding it in the development of company policies and procedures regarding siting matters to ensure regulatory compliance for the construction, modification, and acquisition of hundreds of tower sites.
- Assisted a wide-area broadband communications service provider in the acquisition of over 70 wireless cell sites negotiating tower leases and reviewing towers for regulatory compliance.
- Assisted clients with obtaining waivers of the FCC’s rules where such rules act as impediments to implementing new technology and services.
- Advises wireless service providers offering service in various spectrum bands including cellular, 700 MHz, AWS, Cellular PCS, Citizens Broadband Radio, and microwave in regulatory matters including spectrum acquisitions, leases, licensing, operational matters, rulemaking proceedings and enforcement actions.
- Represents numerous broadband and wireless communications providers before the FCC on licensing and enforcement matters.
