Jeff Barringer focuses his practice on assisting financial services providers, including housing finance lenders, with compliance under state and federal regulatory frameworks. His work frequently involves advising clients as they enter new markets or develop new products and services. He works with clients as their business objectives evolve and provides guidance related to business growth, expanded product offerings, and geographic reach.

Jeff advises financial institutions, mortgage companies, sales finance companies, FinTech companies, and other providers of consumer financial services on compliance with applicable state and federal laws. His experience includes counseling clients on matters related to mortgage lending and servicing, manufactured housing finance, automobile finance, sales finance, secured and unsecured lending, commercial lending, real estate brokerage, and money services businesses.  Jeff also assists clients in connection with the sale of loans, including bulk sale, forward flow and loan participations, as well as ancillary transaction documentation.  

His work includes advising on licensing requirements, usury limitations, preemption issues, and other regulatory compliance matters, including responding to regulatory inquiries and examination findings. Jeff also assists clients with regulatory due diligence and licensing issues in connection with mergers, acquisitions, and asset purchases and sales involving financial services companies, and advises on compliance with the New York Department of Financial Services cybersecurity regulations obligations.

  • Assisted a national lender in launching a new-to-market tiny home and park model RV lending product, addressing the regulatory and licensing considerations applicable to personal property-secured lending.
  • Counsel state-licensed mortgage bankers as they expand product offerings to include manufactured housing–only loans nationwide, including guidance on conduct requirements, usury and fee limitations, disclosures, and promissory note and security agreement terms.
  • Advise lenders and other financial services providers on licensing and regulatory compliance requirements as they expand into new states and introduce new products.
  • Assist manufactured housing lenders with expanding lending footprints and implementing new lending programs.
  • Assist manufactured housing lenders in connection with loan sale and servicing agreements, as well as ancillary transaction documents.  
  • Provide regulatory compliance advice and assist with regulatory approvals in transactions involving state-licensed mortgage lenders and other financial services companies.
  • Perform regulatory due diligence in connection with loan portfolio purchases.
  • Support a national mortgage lender on a consumer credit compliance initiative involving the development of retail installment contracts, promissory notes, security agreements, and residential real estate lending forms, and ongoing monitoring of laws applicable to multiple lending products across numerous states.
  • Represent banks on lending matters, including rate exportation, licensing, and qualification issues.
  • Prepare multistate research regarding rates and fees, disclosures, and substantive conduct requirements affecting real property and personal property financing.
  • Advise clients on how their products and services fit within federal and state money services business regulatory frameworks.
