Womble Bond Dickinson was well represented at The University of South Carolina Joseph F. Rice School of Law Estate Planning Conference, held October 9 – 10th in Columbia S.C.

Partner Carl King took part in a panel discussion on “Incorporating Income Tax Planning into an Estate Freeze for Negative Capital Real Estate.” In addition, Partner Anne Kelley Russell was on the steering committee that planned the successful conference.  Also attending and representing Womble Bond Dickinson were attorneys Laurel R.S. Blair, Briani Bennett, Meri Heneage and Tom Zamadics.

King was joined in the discussion by University of South Carolina Rice School of Law Professor Clint Wallace and long-time professor and attorney Jerome Hesch of Meltzer, Lippe, Goldstein & Breitstone, LLP.  The presentation addressed three key points:

  • How to design a preferred partnership owning encumbered real estate that maximizes the income tax benefits and estate tax benefits.
  • After the preferred partnership freeze has been implemented, how to deal with the excess cash generated upon a future refinancing of the mortgage to further increase the income tax benefits.
  • How to communicate the preferred partnership freeze to potential clients in an understandable manner.
