On February 16, Womble Bond Dickinson partner David Attanasio was a featured contributor to the first part of an eight part series for the Symposium on International Investment Law & Contemporary Crises, presented by Opinio Juris and organized by AHALI Dispute Resolution.
In his contribution, “Crises as Investor-State Dispute Catalysts – The Banking and Finance Sector,” Attanasio—who also co authored the underlying BIICL empirical study—offers sharp insight into how global economic and financial shocks shape investor–state arbitration. Drawing on data from 145 banking and finance ISDS cases, he demonstrates that economic and financial crises often act as the primary catalysts for investor-state disputes in the banking and finance sector, equal to political dynamics or isolated policy decisions.
