Elizabeth Campbell is a partner in Womble's Business Litigation Practice with extensive experience representing corporations and individual clients as plaintiffs and defendants across various sectors, including business torts, financial services, life settlements, complex insurance coverage, restrictive covenants, real estate, and technology issues. She has a multi-jurisdictional presence and handles all aspects of litigation and arbitration, from pre-suit investigations to jury and bench trials in state, federal, and bankruptcy courts.  

Liz regularly litigates cases involving fraud, RICO, breach of contract, partnership dissolutions, unfair business practices, trade secrets and restrictive covenants, technology problems, and real estate disputes. She counsels clients on issues involving injunctive relief, enforcement of settlements and arbitration awards, appeals, and alternative dispute resolution options. She also advises clients on ‎life settlement matters, complex insurance coverage issues, excess liability and bad faith claims, and reinsurance.

  • Secured a preliminary injunction on behalf of a privately held ‎communications company and its related German affiliates against ‎two former officers and directors, preventing access to and ‎disposition of millions of dollars in corporate assets
  • Represented former employee and new employer in restrictive ‎covenant and theft of trade secrets dispute involving proprietary ‎conveyor belt industrial technology
  • Obtained complete summary judgment for a large corporation ‎against multi-million dollar copyright infringement claims brought ‎by former employee
  • Obtained early dismissal in a large commercial action ‎involving 28 defendants where multiple claims of fraud, ‎misrepresentation, negligence, and breach of contract were alleged
  • Represented global provider of wireless communications ‎infrastructure in contractual and premises liability disputes
  • Defended technology maintenance company in contract, breach of ‎fiduciary duty, DMCA, and trade secret lawsuit over allegedly ‎unauthorized use of software programs and proprietary computer ‎equipment

Insurance

  • Represented non-admitted reinsurer and its officers and directors ‎in reinsurance trust dispute and run-off claims issues with ceding ‎insurer in connection with CGL, auto, trucking, and workers' ‎compensation portfolios
  • Defended reinsurer and individual executives in dispute with ‎ceding insurer and trust account holder over alleged improper ‎release of reinsurance trust account funds following commutation ‎of quota-share reinsurance treaties
  • Defended auto insurer in dispute with specialized software and ‎technology services company over failed development and ‎implementation of customized industry-related software
  • Regularly advises insurers on statutory obligations regarding the ‎use of external consumer data and information sources in ‎underwriting for certain types of insurance
  • Handles complex coverage, bad faith, and excess liability claims in ‎Georgia and Florida

Financial Services

  • Frequently defends financial services companies in cases alleging ‎violations of the Telephone Consumer Protection Act (TCPA), ‎Truth in Lending Act (TILA), the Real Estate Settlement ‎Procedures Act (RESPA), the Fair Credit Reporting Act (FCRA), ‎the Fair Debt Collection Practices Act (FDCPA), the Equal Credit ‎Opportunity Act (ECOA), provisions of the U.S. Bankruptcy Code ‎and Bankruptcy Rules, and state consumer protection statutes

  • Defended multiple class actions against residential mortgage ‎servicers and affiliates alleging improper late fees, property-‎inspection fees, property-valuation (BPO) fees, and other charges ‎for default-related services

E-Discovery & Technology

  • Coordinates and manages large-scale litigation matters involving ‎electronic discovery for medium and large businesses
  • Advises clients regarding protection and management of ‎confidential financial and personal data as well as proprietary and ‎other information to prevent other cyber risk exposures
  • Regularly counsels clients and speaks on best practices in ‎document retention policies and e-discovery

  • Defended large companies, national banks, loan servicers, and ‎insurers in high-stakes class action cases in courts across the ‎Southeast in consumer fraud, deceptive trade practices, and FLSA ‎matters
  • Secured multiple early dismissals of putative class actions in ‎Georgia and Florida in cases involving FDCPA, FCRA, RESPA, ‎and TILA allegations
