ATLANTA—Womble Bond Dickinson attorney Jim Cooley helped lead a webinar discussion on “Saving Money Through ADR: What Corporate Counsel Need to Know About Damage and Loss Calculations in Disputes” for the Georgia Chapter of the Association of Corporate Counsel (ACC).
As pressure mounts on corporate counsel to proactively manage contractual disputes cost-effectively, they will need to be able to assess damages earlier and accurately. This will require judgment calls on whether to resolve the disputes through an uncertain litigation or arbitration process, alternatively negotiate directly, or through pre-litigation mediation. To do this, corporate counsel will need to understand better the nature and rationale for costs, expenses, and potential damages that may or may not be recoverable.
