Womble Bond Dickinson Partners Arthur Ebbs, Jim Milano, and David Tallman all spoke at the Mortgage Bankers Association Combined Risk Management Conference, which took place September 27-29 in Washington, D.C.
Ebbs spoke on “Bankruptcy and Data Breaches.” This session highlighted recent cases and litigation developments relating to bankruptcy and data breaches.
Milano took part in a panel discussion on “Innovation in Mortgage Lending – Balancing Affordability, Compliance, and Risk.” As lenders explore innovative financing solutions to address housing affordability, compliance and risk considerations remain critical. This session examined emerging mortgage products, including leasehold mortgages and other alternative financing structures, and the regulatory, fair lending, operational, and GSE requirements organizations should evaluate before bringing these products to market.
Tallman discussed “Contact with Care - Navigating Borrower Communications and Consumer Protection Laws.” Borrower communications present complex compliance challenges that require balancing regulatory requirements with effective customer engagement. In this session, industry experts work through real-world fact patterns involving borrower outreach, credit reporting, debt collection, and communications across multiple channels to illustrate how the Fair Credit Reporting Act (FCRA), Fair Debt Collection Practices Act (FDCPA), Telephone Consumer Protection Act (TCPA), and other consumer protection laws apply in practice.
