Our Appellate Litigation team briefs and argues significant appeals in state and federal courts, and has appeared before the Supreme Court of the United States, federal courts of appeal across a number of circuits including the Second, Fourth, Seventh, Ninth, Eleventh and D.C. Circuits, as well as state appellate courts in North Carolina, South Carolina, Virginia, Georgia, California and the District of Columbia.
Many of our attorneys served trial and appellate clerkships on various federal and state appellate courts and the North Carolina Business Court. For example, four members served appellate court clerkships on the US Court of Appeals for the Fourth Circuit. Members of this team have also served on important commissions including the National Conference of Chief Justices' Committee on Professionalism, have been published in the Harvard Law Review, and have lectured at Duke University, the University of North Carolina at Chapel Hill and other leading law schools.
Our appellate litigators understand the decision-making process of appellate judges and have an ear for arguments that resonate with those judges. In both our written and oral advocacy, we seek to identify and frame issues in a persuasive and creative fashion. Our objective in each appeal is to show both that our clients are entitled to a ruling based on the law and facts, but also to persuade judges that they should want to rule in favor of our client.
The firm has performed appellate work for Fortune 500 clients in a broad spectrum of industries, including banking, telecommunications, automotive, pharmaceutical, manufacturing, insurance, and retail sales. The firm has also appealed criminal cases ranging from complex “white collar” cases to death penalty matters. In addition, we have participated in appeals by filing amicus curiae briefs on behalf of interested industries or groups that are not parties to the litigation.
We further provide strategic counsel and advice on constitutional and other complex legal issues arising outside of the traditional appellate context. This includes counseling trial attorneys and preparing briefs in trial courts to ensure that legal issues are properly preserved for appeal. Our lawyers also develop constitutional and public policy arguments concerning proposed legislation.
