DynaEnergetics Europe GmbH earned a complete litigation victory in the Western District of Texas, as a jury ruled the company did not infringe rival Repeat Precision LLC’s patent on a tool used in oil and gas drilling. The jury rejected the plaintiff’s request for $1.7 million in damages.

The jury verdict is just the latest in a series of IP litigation successes for Dyna Energetics and the Womble Bond Dickinson team, which includes Partners Barry Herman, Christy Dupriest and Preston Heard. The WBD team has worked closely on all of these cases with attorneys from Moyles IP (including Lisa Moyles and Jason Rockman), who joined WBD in April 2023.

In the March 28 decision, the jury deliberated less than four hours before rendering a verdict in favor of DynaEnergetics. Herman and the defense team presented evidence that DynaEnergetics drilling tool is substantively different than Repeat’s product. 

When reading the verdict, Judge Alan Albright said of both parties, “I have the greatest job in the world…you’re not going to see lawyers better than this ever, full stop.”
