Scot Anderson Discusses “The Role of State-Owned Companies in the Mining Sector”

Scot Anderson, Co-Office Managing Partner of Womble Bond Dickinson’s Denver office, recently spoke on “The Role of State-Owned Companies in the Mining Sector.” The June 23 webinar was presented by the International Bar Association’s Mining Law Committee.
Given the importance of minerals – and particularly critical minerals – for various industrial sectors in different countries and considering geopolitical issues that may limit the access to such minerals, countries with significant mineral resources may adopt different approaches to control those resources and extract value from them. One approach commonly used in some jurisdictions is the creation of state-owned companies to develop and operate mines, in some cases as mandatory joint ventures of private companies and investors.
In this webinar, the panel discussed the risks and potential benefits of state-owned companies for the mining sector, as well as the effectiveness of the model and which lessons can be drawn from case studies.
Anderson was joined in the discussion by Loyola Rwabose Karobwa of Uganda’s Ministry of Energy and Mineral Development and Lombe Mbalashi of Mbalashi C and Associates in Zambia. Adriano Drummond Trindade of Brazilian firm Mattos Filho and the Treasurer of the IBA Mining Law Committee moderated the discussion.
