About the Program

This program will address the complex landscape of intellectual property in federal contracting, focusing on software and technical data rights.  The program will cover the different categories of rights, including unlimited rights, government purpose rights, limited/restricted rights, specially negotiated rights, SBIR rights, and commercial.  We will discuss the key FAR/DFARS regulations, their accompanying contract clauses, and implications for software development and licensing.  We will also address critical issues such as the allocation of rights between contractors and the government, protection of proprietary information, traps for the unwary, and strategies for protecting items developed at private expense.  Attendees will leave with a solid understanding of how to navigate the intricate world of software and data rights in government contracts, enabling them to better protect their interests and maximize opportunities in this specialized field.

About the Speakers

Chris Lockwood is an experienced government contracts litigator and legal advisor who assists clients in all aspects of federal procurement law, including FAR and DFARS compliance, small business issues, SBIR topics, and data rights. Chris has handled numerous bid protests at the U.S. Court of Federal Claims and GAO, as well as size protests before the SBA and its Office of Hearings and Appeals.  Chris has been recognized in The Best Lawyers in America for Government Contracts and is a past officer and frequent speaker for professional organizations such as the National Contract Management Association and the North Alabama Federal Bar Association.

R. Andrew Walden is a Partner at Womble Bond Dickinson in Charleston, South Carolina, where he focuses on litigation. Andrew has extensive experience in government contracts and construction litigation, having litigated numerous cases in both state and federal courts involving contract and business disputes. He previously served as an Army Officer in the U.S. Army Judge Advocate General's (JAG) Corps, Reserve Component, until 2024. Andrew has been recognized by Best Lawyers as "One to Watch" for Alternative Dispute Resolution and Commercial Litigation. He received his undergraduate degree from the College of Charleston and is licensed to practice in South Carolina.
