On February 16th, the Council on Environmental Quality (“CEQ”) published an interim document to guide the regulation and permitting of carbon capture, utilization, and sequestration (“CCUS”) technologies. The guidance document, titled “Carbon Capture, Utilization, and Sequestration Guidance”, is divided into four sections that include:

  • Facilitating Federal Decision Making on CCUS Projects and Carbon Dioxide Pipelines
     
  • Public Engagement and Interdisciplinary Research
     
  • Understanding Environmental Impacts
     
  • Carbon Capture and Utilization and Carbon Dioxide Removal

The aim of the interim CCUS Guidance is to “facilitate reviews associated with the deployment of CCUS and to promote the efficient, orderly, and responsible development and permitting of CCUS projects at an increased scale in line with the Administration's climate, economic, and public health goals.”
