  • Represented a merchant services provider in an arbitration filed by a former strategic partner alleging that the company had breached an independent contractor agreement and committed tortious interference, negligence, and conversion. The company won the evidentiary hearing on the former partner’s request for injunctive relief, enabling the company to withhold millions of dollars of compensation due to the former partner’s misconduct, and an appeal before the U.S. Court of Appeals for the Ninth Circuit. The company then countered-sued for millions of dollars of additional damages. 
  • Represented a merchant services provider in litigation brought by a former strategic partner alleging that the company had breached independent contractor and option agreements and fiduciary duties and committed negligence, civil conspiracy, and conversion. 
  • Represented a merchant services provider in litigation against a former member of its board of directors, who shared the company’s strategic information with a competitor, tried to usurp the company’s corporate opportunities and sabotage its relationships and opportunities in breach of his fiduciary duties, and interfered with the company’s contracts and relationships.
