Robert Neilson advises financial institutions, creditors, and other stakeholders on a broad range of matters involving loan modifications and restructuring, commercial and residential foreclosures, enforcement of security interests, and the enforcement of domestic and foreign judgments. His practice also includes creditors’ rights litigation across all stages of the process. He represents many auto and equipment lenders/financers, financial institutions, and various other creditors in both consumer and commercial matters.

Robert has extensive experience representing financial services and title insurance companies in real property disputes, including matters involving deed and mortgage reformation, access issues, and priority disputes. His practice also includes assisting clients in the areas of commercial loan litigation, loan workouts, contract disputes, and commercial foreclosures. He handles claims ranging from state common law causes of action to alleged violations of federal and state statutes, including the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, the Florida Consumer Collection Practices Act, the Real Estate Settlement Procedures Act, the Telephone Consumer Protection Act, and the Truth in Lending Act, as well as state laws governing fair lending, debt collection, and unfair or deceptive trade practices.

As part of the national replevin program, Robert provides value to clients by offering one-stop shopping for recovery of distressed assets. Robert handles all aspects of his clients’ recovery needs, including but not limited to, filing replevin/detinue actions, impound litigation, defending forfeiture actions, obtaining monetary judgments, and pursuing deficiency litigation.
