Our appellate team briefs and argues significant appeals in state and federal courts. Our attorneys have handled matters before the Supreme Court of the United States, federal appellate courts across the country, and numerous state appellate courts.

Many of our attorneys have clerked for federal appellate judges. Our group is led by an accomplished appellate lawyer who was a law professor at Duke Law School for over a decade, teaching appellate practice, handling complex federal appeals as the Director of Duke’s Appellate Litigation Clinic, and working with federal appellate judges to train Duke students for appellate advocacy.

Our appellate litigators understand the decision-making process and perspectives of appellate judges and have an ear for arguments that resonate with and captivate the appellate judicial audience. In both our written and oral advocacy, we seek to identify and frame arguments in a persuasive and creative fashion. Our objective in all cases is not only to show that the law and record warrant ruling for our clients, but also to persuade judges that they should want to rule in favor of our clients. This entails, among other things, effective narratives, policy considerations, and practical implications, while assuaging judicial concerns about our counterarguments. 

The firm has performed appellate work in a full range of civil matters, including intellectual property disputes, and across a broad range of industries, including banking, software, telecommunications, automotive, pharmaceutical, manufacturing, insurance, and retail sales. The firm has also handled criminal appeals in complex white-collar cases. And we have filed amicus curiae briefs on behalf of industries and groups.

But our work is not limited to appeals. We also provide strategic counsel and advice on constitutional and other complex legal issues arising outside of the traditional appellate context. This includes counseling trial attorneys and preparing briefs in trial courts to ensure that legal issues are properly preserved, and strategically positioned, for appeal. Our lawyers also craft constitutional and public policy arguments concerning proposed legislation and agency action.
