Kyle Kellar leverages over a decade of experience in all aspects of Intellectual Property to provide his clients with a full suite of IP-related legal services.  Kyle’s broad base of experience allows him to proactively protect his clients’ Intellectual Property and business interests.

Kyle has experience drafting and prosecuting trademark and patent applications spanning the fields of mechanical and electro-mechanical devices, medical devices, and display panels to secondary batteries, battery packs, and battery controllers to agricultural machinery and horticultural lighting systems.  In addition to patent prosecution, Kyle also represents his clients in trademark and patent litigation and pre-litigation matters, including in Inter Parties Review proceedings before the Patent Trial and Appeal Board and at the District Court and Appellate levels.

  • Wavve Americas v. Tumi Max (D. Az.) – Successfully shut down copyright piracy operation involving Korean-originating television shows.
  • Sani-Tech West v. Meissner Filtration Products (PTAB) – Successfully defeated petition for Inter Partes Review of client’s patent prior to institution.
  • Blumenthal Distributing d/b/a Office Star v. Herman Miller (C.D. Cal.) - Represented Plaintiff in declaratory judgment action regarding trade dress infringement leading to a favorable settlement.
  • Merchsource v. Hyper Ice (PTAB) – Defeated petition for Inter Parties Review of client’s patent prior to institution.
  • Blumenthal Distributing d/b/a/ Office Star v. Gamesis (C.D. Cal.) – Shut down website purporting to resell client’s products
  • Ascend Performance Materials Operations v. Samsung SDI (PTAB) – Defended Samsung SDI’s patent in an Inter Parties Review proceeding before the Patent Trial and Appeal Board.
  • Kiss Nail Products v. Tianjin Shuangrong Paper Products (PTAB) – Challenged patent asserted against client at the PTAB leading to favorable settlement.
  • Electric Power Group v. Alstom (C.D. Cal.) – Represented plaintiff in complex patent infringement suit involving power grid monitoring systems.
