With the 2026 midterm elections just days away, the energy sector faces the possibility of a divided government, with Republicans controlling the White House and Democrats holding the majority in one or both branches of Congress.

However, elected officials also are facing significant pressure from the public to lower costs for the average American, including electricity bills. This potentially presents avenues for bipartisan cooperation.

S&P Global recently spoke with Womble Bond Dickinson Partner Kristina Moore and other Capitol Hill insiders about how the elections may impact the energy sector.

Moore said the private sector could face a new wave of investigations under a Democratic Congress. With the Trump Administration seeking to extend its Executive Privilege protections, Congressional committees may instead seek that information from private sector advisors to the White House.

She also noted that states may launch their own related legal inquires, which energy companies also need to be aware of.
