Law360 recently featured insights from Womble Bond Dickinson Partner Luke Cass regarding the rapid expansion of the DOJ's National Fraud Enforcement Division (NFED) and the impact its "all-tools" approach is having on corporate enforcement and internal investigations. 

According to Luke Cass, companies should expect investigations to move faster as NFED leverages artificial intelligence, data analytics, and unprecedented coordination across enforcement agencies. He noted that the new enforcement environment places increased pressure on organizations to promptly assess allegations, preserve evidence, and conduct internal investigations.

“It’s putting a little more of the burden on the defense side to move a bit quicker — and it underscores the importance of having effective compliance programs and being able to do internal investigations very promptly.”

“The government is very prepared from the jump out of the gate, so you have to respond with similar alacrity and speed.”
