Scott Hyman Authors Article on “California’s Prohibition Against Underground Regulation”

Womble Bond Dickinson Partner Scott Hyman, former Womble associate Justin Bradley (now Deputy General Counsel of Worldwide Acceptance Corporation), and veteran California financial services attorney Paul Soter co-authored an article on “California’s Prohibition Against Underground Regulation”. This article was published in the Conference on Consumer Financial Law Quarterly Report (vol. 78, no. 1).

The article explores California’s prohibition against ‘regulation-by-enforcement’ as contrary to California’s statutory and judicially developed prohibition against “underground regulation”.  

Hyman is the author of the California CEB’s Practice Guide on The Fair Debt Collections Practices Act, the co-author of the California CEB’s Practice Guide on the California Department of Financial Protection and Innovation’s Enforcement Authority, and is currently serving his second successive term on the California Department of Financial Protection and Innovation’s Debt Collection Advisory Committee.
