Womble Bond Dickinson is pleased to host the International Trademark Association (INTA) North America Roundtable, A Journey of a Dupe: Crossing the Line from Dupe to Counterfeit on April 8 in the firm’s Phoenix office.
Led by WBD partners Rachel Nicholas and David Jackson, the session will include a deep dive into the legal distinctions between counterfeit goods and “dupes” (duplicate products inspired by luxury or brand-name items). The discussion will examine the intellectual property protections available to brand owners—including trademark law under the Lanham Act, trade dress, design patents, and copyrights—and will explore when a dupe crosses the line from lawful imitation to actionable infringement, counterfeiting, or false advertising.
The roundtable will also review recent case examples involving major brands such as Estée Lauder, Lululemon, Coach/Tapestry, and Williams-Sonoma, with a focus on how courts evaluate likelihood of confusion, secondary meaning, functionality, and other key legal standards relevant to brand enforcement.
