The FCC will consider at its Open Meeting this Wednesday, December 13, 2023, a TCPA item focused on “robotexting”, which will be the second item considered at the meeting, scheduled to commence at 10:30 a.m. ET.
The Commission will be considering a TCPA Second Report and Order, Second Further Notice of Proposed Rulemaking and Waiver Order. The Order would:
- Require terminating wireless carriers to block texts from particular numbers when notified to do so by the Commission;
- Codify do-not-call rules for texting; and
- Close what the Commission characterizes as the “lead generator loophole”, making clear that lead generators must obtain separate consumer consents for particular sellers in comparison shopping and similar websites.
The item also seeks comment on further proposed efforts to combat illegal robocalls and robotexts, including on additional blocking options for originating mobile carriers, text authentication and wireless traceback issues, and on wireless email-to-text services.
