LISBON, PORTUGAL—Womble Bond Dickinson attorney Lisa Bondurant moderated a discussion on “Evolving Insurance Challenges in Opioid Litigation” at the 2018 International Association of Defense Counsel (ADC) Annual Meeting.
The opioid epidemic has led to an explosion of lawsuits by states, counties, cities, and Native American nations against pharmaceutical manufacturers and distributors of opioid drugs as well as pharmacies. The allegations of these suits run the gamut from negligence and product liability to claims under consumer fraud statutes and the False Claims Act. These cases raise novel issues for insurers and their insureds alike, and they have given rise to significant coverage litigation. This presentation examined recent decisions and pending cases affecting insurance coverage for opioid litigation. Panelists discussed the ways in which courts are addressing claims based on the types of allegations in the underlying complaints and provided guidance for what to expect as the courts refine the law in this emerging coverage arena.
The panel discussion took place July 8. Joining Bondurant in the discussion were Mario Fiorino of the Insurance Bureau of Canada, Michael Hamilton of Goldberg Segalla LLP and Albert Hilber of Swiss Re American Corporation.
The IADC Annual Meeting was held this year in Lisbon. Former Portuguese Prime Minister José Manuel Barroso was the keynote speaker for the event.
