Womble Carlyle attorney Kevin Mangan successfully defended a Delaware law firm in a Fair Debt Collection Practices Act claim filed in the US District Court for the District of Delaware.

The plaintiffs filed for Chapter 13 bankruptcy after becoming delinquent on their home mortgage. The plaintiffs then sued their loan servicing company in a dispute over how much the plaintiffs still owed in arrearage. 

That case was settled, but the plaintiffs then sued the law firm, which acted as legal counsel for the loan processing company during the bankruptcy proceedings. The plaintiffs alleged the firm provided misleading information during those proceedings, in violation of the Fair Debt Collection Practices Act. Additionally, the plaintiffs claimed Intentional Infliction of Emotional Distress and other causes of action.

Mangan filed a Motion to Dismiss all claims against the law firm in June 2015, with oral argument held in December 2015. On March 30, 2016, the Court granted the defendant’s Motion to Dismiss.
