Bloomberg Law turned to Womble Bond Dickinson litigator Artin Betpera today for insight on how lawsuits involving Charter Communications and Facebook might impact the Telephone Consumer Protection Act (TCPA). In separate cases challenging TCPA, the two companies argued before the US Court of Appeals for the Ninth Circuit that the federal robocall law violates the First Amendment.
Betpera told Bloomberg that the Ninth Circuit has dismissed First Amendment challenges to TCPA in the past but added that the court’s tendency to be protective of the First Amendment leaves the possibility for a surprising outcome.
