Greenwashing crackdown gathers pace with potentially significant fines on the horizon

Companies that use misleading environmental claims could face fines of up to tens of millions of pounds under proposals to strengthen the enforcement of consumer laws.

The Digital Markets, Competition and Consumer Bill was finally published on 25 April 2023 and could become law later this year. The Bill proposes a raft of reforms to strengthen the enforcement of consumer protection laws by, for example, handing the Competition and Markets Authority (CMA) the ability to decide when consumer law has been infringed and to then directly fine companies up to 10% of their global turnover. This would replace going through a court process that can take years.

The be-gin-ning of the end? Aldi found to infringe M&S' designs for festive liqueur bottles

Casting our minds back to the festive period of 2021, news that Marks & Spencer had launched legal proceedings against Aldi for copying its products – at that time, its decorative gin liqueur bottles – was a hot topic in the general media.

Just over a year later (a decent timeframe for the first stage of intellectual property infringement proceedings), Judge Hacon sitting in the Intellectual Property Enterprise Court has held that Aldi has indeed infringed Marks & Spencer's registered design rights.

Womble Bond Dickinson bolsters Teesside presence with Wilton office move

International law firm Womble Bond Dickinson (WBD) is expanding its presence in Teesside and moving into a larger office at the Wilton Centre, adjacent to the Wilton International site, one of the key areas comprising Teesside's industrial cluster and part of the Teesside Freeport.

In late January, WBD moved into a larger (1,239 sq ft) and more vibrant working environment providing enhanced collaborative and client workspaces, facilities and technology-enabled rooms.

Frosty reception: Iceland Foods' only EU trade marks invalidated

In December 2022, the European Union (EU) Intellectual Property Office (IPO) Grand Board of Appeal decided to cancel EU trade mark registrations belonging to Iceland Foods Limited (IFL) for ICELAND and the figurative mark (right). The Grand Board confirmed the earlier invalidity decisions stating that the marks in question would be perceived by the relevant public as indicating that the goods and services provided under the marks originate from Iceland, as opposed to from IFL. The decision (at publishing, still subject to appeal) could mean that IFL loses all of its EU-wide registered trade mark protection for its key brand; these are the only EU trade mark registrations belonging to IFL on record.
